This Privacy Policy explains how MyTherapist ("we," "us," or "our") collects, uses, shares, and protects information when you use the MyTherapist application, website (https://mytherapist.health), and related services (the "Service"). Because MyTherapist supports mental wellness and may process health-related and biometric information, we treat your data with heightened care.

1. Introduction and Scope

This Policy applies to information we process about users of the Service in the United States and in other countries where the Service is available. It supplements any notices provided at the point of collection. By using the Service, you acknowledge this Policy.

2. Information We Collect

  • Account information: name, email, phone number, age/date of birth, and credentials.
  • Health and biometric information: information you provide about your mental wellness, and data from connected wearables and health platforms (such as Oura and Google Fit), which may include heart rate, sleep, activity, and related metrics.
  • Conversation content: messages and inputs you provide to AI features and supportive chat.
  • SMS/messaging data: phone number, consent records, and message activity.
  • Calendar data: where you connect a calendar (such as Google Calendar), event and scheduling data you authorize.
  • Payment information: processed by our payment processor (Stripe); we do not store full card numbers.
  • Device and usage data: device identifiers, app interactions, and log data.

3. How We Use Information

We use information to: provide and personalize the Service; operate AI-assisted features; process payments and subscriptions; send transactional and (with consent) marketing messages; maintain safety and security; comply with legal obligations; and improve the Service.

4. AI and Automated Processing

The Service uses artificial-intelligence and large-language-model technology to power supportive conversation and related features. Your conversation content and certain inputs may be processed by AI model providers acting on our behalf to generate responses. We do not use your conversation content to train or improve artificial-intelligence or machine-learning models, and we instruct our AI providers not to use it for their own model training. AI outputs are supportive tools and are not medical advice.

5. How We Share Information

We do not sell your personal information. We share information with service providers (sub-processors) only as needed to operate the Service, including:

  • Payments: Stripe.
  • Telecom / SMS: messaging and telephony providers.
  • Wearables and health data: Oura, Google Fit (only data you connect).
  • Calendar: Google Calendar (only data you connect).
  • AI providers: model providers that process conversation content to deliver AI features.

We may also disclose information to comply with law, enforce our Terms, protect rights and safety, or in connection with a business transfer. We do not currently use third-party analytics or advertising providers; if we adopt them in the future, we will update this Policy before doing so.

Mobile information and SMS consent. We do not sell, rent, or share your mobile phone number or SMS opt-in consent with third parties or affiliates for their own marketing or promotional purposes. Phone numbers and SMS consent records are shared only with our telecom and messaging sub-processors solely to deliver the messages you have requested (such as appointment and session reminders, verification codes, and support replies). No mobile information is shared with any third party for marketing purposes under any circumstances.

6. Children's Privacy (COPPA)

The Service is intended for users aged 13 and older. We do not knowingly collect personal information from children under the age of 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly. If you believe a child under 13 has provided us with personal information, please contact us using the details in the "Contact Us" section so we can remove it. For Minors aged 13–17, a parent or guardian's involvement and consent is required, and parents or guardians may review or request deletion of a Minor's information by contacting us.

7. Your State Privacy Rights

Depending on where you live, you may have rights under state privacy laws. We honor these rights for residents of all US states that provide them.

  • California (CCPA/CPRA): rights to know, access, delete, correct, and opt out of "sale" or "sharing" of personal information, to limit use of sensitive personal information, and to non-discrimination for exercising rights. California residents may also use an authorized agent and have "Shine the Light" rights.
  • Nevada (NRS 603A): the right to submit a verified request directing us not to sell certain covered personal information.
  • Washington (My Health My Data Act): rights regarding consumer health data, including consent, access, and deletion, and a right to withdraw consent.
  • Virginia, Colorado, Connecticut, Utah, and other states with comprehensive privacy laws: rights to access, delete, correct, port, and opt out of targeted advertising, sale, and certain profiling, subject to each state's law.

To exercise any right, use the contact details below. We will verify your request and respond within the time required by applicable law. If we deny your request, you may appeal by replying to our decision or by emailing support@mytherapist.health with the subject line "Privacy Appeal."

8. Data Retention

We retain personal information for as long as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. You may delete your account at any time from Settings. Deleting your account deactivates it immediately and permanently removes your data after a 30-day grace period, during which you can restore the account by logging back in. You may also request deletion by contacting us. When information is no longer needed, we delete or de-identify it.

9. Security

We use administrative, technical, and physical safeguards designed to protect your information. No system is completely secure, and we cannot guarantee absolute security. If we learn of a breach affecting your information, we will notify you as required by law.

10. Your Choices

You can: update account information in settings; reply STOP to opt out of SMS at any time, or HELP for help (message and data rates may apply, and message frequency varies); opt out of marketing emails; disconnect wearables, calendar, or other integrations; delete your account yourself from Settings (subject to a 30-day recovery window); and request access to or deletion of your information by contacting us. Some features may not function if you disable certain data collection.

11. International Users

The Service is operated from the United States and is available to users in the United States and other countries. Wherever you access the Service from, your information is processed and stored in the United States, which may have data-protection laws different from those in your country. By using the Service, you consent to the transfer and processing of your information in the United States.

12. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
