These Terms & Conditions ("Terms") govern your access to and use of the MyTherapist application, websites (including https://mytherapist.health), and related services (collectively, the "Service"), operated by MyTherapist ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of a minor, you accept these Terms on their behalf and on your own behalf.
2. Eligibility and Age Requirements
The Service is available to users aged 13 and older. The Service is not intended for, and we do not knowingly allow, children under the age of 13. Users between the ages of 13 and 17 ("Minors") may use the Service only with the involvement and consent of a parent or legal guardian, who is responsible for the Minor's activity and agrees to these Terms on the Minor's behalf. By using the Service, you represent that you are at least 13 years old.
3. Description of the Service; Not a Medical Service
MyTherapist provides AI-assisted mental wellness and supportive conversation tools, and may facilitate features such as progress tracking, scheduling, biometric integrations, and messaging.
⚠️ Important: The Service is not a substitute for professional medical advice, diagnosis, treatment, or therapy by a licensed clinician. The AI features are supportive tools and do not provide medical or psychological diagnosis or treatment. Always seek the advice of a qualified health provider with any questions regarding a medical or mental-health condition.
In a crisis or emergency, do not use the Service. Call 911 (or your local emergency number), or call or text the 988 Suicide & Crisis Lifeline (in the US) immediately.
4. Accounts, Security, and Parental Responsibility
You agree to provide accurate information, keep your credentials secure, and be responsible for all activity under your account. Notify us promptly of any unauthorized use. Parents and guardians are responsible for supervising any Minor's use of the Service and for the accuracy of information provided on a Minor's behalf.
5. SMS and Text Messaging Terms
If you provide a mobile number and opt in, you consent to receive text messages from MyTherapist, which may include account, reminder, and (where separately consented) marketing messages. Consent is not a condition of purchase. Message and data rates may apply, and message frequency varies. Reply STOP to unsubscribe or HELP for help. We handle SMS consent in accordance with the Telephone Consumer Protection Act (TCPA) and applicable law. Carriers are not liable for delayed or undelivered messages.
We do not sell, rent, or share your mobile phone number or SMS opt-in consent with third parties or affiliates for their own marketing or promotional purposes. Phone numbers and consent records are shared only with our telecom and messaging providers solely to deliver the messages you have requested.
6. Subscriptions, Billing, and Cancellation
Certain features require a paid subscription. Payments are processed by our third-party payment processor (Stripe). By subscribing, you authorize recurring charges to your payment method at the then-current price until you cancel. Subscriptions renew automatically for the applicable period unless cancelled before the renewal date. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period. Payments are non-refundable except where required by applicable law.
7. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) misrepresent your identity or provide false information; (c) attempt to reverse engineer, disrupt, or gain unauthorized access to the Service; (d) upload harmful code or content that is abusive, harassing, or infringing; or (e) use the Service to provide professional medical advice to others. We may suspend or terminate accounts that violate these Terms.
8. User Content and AI Interactions
You retain ownership of the content you submit ("User Content"), including messages and inputs to AI features. You grant us a limited, non-exclusive license to use, process, and store User Content as necessary to operate and improve the Service, consistent with our Privacy Policy. We do not use your conversations or other User Content to train artificial-intelligence or machine-learning models. You are responsible for the content you submit and represent that you have the rights to submit it.
9. Intellectual Property
The Service, including its software, design, text, and trademarks, is owned by MyTherapist or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms.
10. Third-Party Services
The Service integrates with third-party services, which may include payment processing (Stripe), telecom/SMS providers, wearable and health-data providers (such as Oura and Google Fit), calendar providers (such as Google Calendar), and AI model providers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or appropriate for your circumstances. The Service does not provide medical advice.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYTHERAPIST AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless MyTherapist and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
14. Dispute Resolution; Arbitration; Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration rather than in court, and you and MyTherapist each waive the right to a jury trial and to participate in a class action, except where prohibited by law. The arbitration will take place in Clark County, Nevada. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@mytherapist.health with your name and a statement that you decline arbitration.
15. Termination
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.
16. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, where required, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
